Terms of Use
These terms cover the Briefwell app for Mac and this website. They're written to be read. By downloading or using Briefwell, you agree to them.
Who we are
Briefwell is made by ADK Interactive, LLC, a New York company ("we", "us"). You can reach us at hello@briefwell.app.
It's a beta
Briefwell is free while it's in beta. Features may change, break, or go away, and we may stop offering the beta at any time. We may charge for future versions; if we do, we'll say so before you pay anything.
Your license
We give you a personal, non-exclusive, non-transferable license to install and use Briefwell on Macs you own or control, for yourself or your work. Please don't resell it, redistribute it, or try to get around how it's licensed or signed. Everything else about the app stays ours.
Names and logos
Briefwell, the Briefwell logo, and ADK Interactive are names and marks of ADK Interactive, LLC. Please don't use them in a way that suggests we made, endorse, or are connected to something we aren't. Other names mentioned here, like Claude, Notion, Confluence, Outline, Microsoft Teams, Google Meet, and Zoom, belong to their owners, who aren't connected to Briefwell.
Who can use it
Briefwell isn't meant for children under 13. To use it, you need to be old enough to agree to these terms where you live, and if you use it for work, you're agreeing for yourself and confirming you're allowed to use it there.
Recording people is on you
Briefwell records audio from your microphone and from apps on your Mac. Recording laws differ by place. Some states and countries require everyone on a call to agree before anyone records it. You are responsible for knowing the rules where you and the other people are, for telling people you're recording, and for getting their consent when the law requires it. Don't use Briefwell to record anyone without the permission the law requires.
Your content stays yours
Recordings, transcripts, minutes, and notes you make with Briefwell belong to you. They're stored on your Mac, and we don't receive them. See the Privacy Policy for exactly what leaves your Mac and when.
Other services
Briefwell can work with services run by others, such as Anthropic's Claude, Apple Notes and iCloud, Notion, Confluence, Outline, and calendar providers. You connect those with your own accounts and keys, and your use of them is covered by their terms and privacy policies, not ours. We aren't responsible for those services or for what they do with what you send them.
Check the minutes
Transcripts, speaker names, and minutes are made by software and AI, and they can be wrong or incomplete. Review anything important before you rely on it or share it.
Updates
Briefwell checks briefwell.app for new versions and can install them for you. You can check for updates by hand from the Briefwell menu. Updates may change how the app works; these terms apply to them too.
No warranty
Briefwell is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We don't promise that Briefwell will be uninterrupted, error-free, accurate, or secure, or that it will capture every word of every meeting.
Limits on our liability
To the fullest extent the law allows, ADK Interactive, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or business, arising from your use of Briefwell or this website. Our total liability for any claim relating to Briefwell is limited to the greater of the amount you paid us for Briefwell in the twelve months before the claim, or fifty U.S. dollars.
Some places don't allow these limits, so some of them may not apply to you.
If a claim comes back to us
If someone makes a claim against ADK Interactive, LLC because of how you used Briefwell, such as recording people without the consent the law requires, sharing minutes you didn't have the right to share, or breaking these terms, you agree to defend us, cover our reasonable costs, including lawyers' fees, and hold us harmless.
Stopping
You can stop using Briefwell at any time by deleting it. We may end your license if you break these terms. The sections on recording, your content, no warranty, limits on liability, claims that come back to us, governing law, and the fine print keep applying after that.
Governing law
These terms are governed by the laws of the State of New York, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in New York, and you and we agree to their jurisdiction.
The fine print
These terms and the Privacy Policy are the whole agreement between you and us about Briefwell. If a court decides part of them can't be enforced, the rest still applies, and that part is enforced as far as the law allows. If we don't enforce something right away, we haven't given it up. You can't transfer your license or these terms to someone else without our written okay; we can transfer them, for example if Briefwell or ADK Interactive is sold.
Changes
We may update these terms. When we do, we'll change the date at the top of this page. If a change is significant, we'll point it out on this site or in the app. Using Briefwell after a change means you accept the new terms.
